6. Creator Content and Resources

Jade Vanity Gaming provides various creator content and resources, including but not limited to game guides, tutorials, reviews, graphic design resources, music production content, and community resources ("Creator Content"). All Creator Content is protected by copyright and other intellectual property laws.

6.1 Use of Creator Content

You may use our Creator Content for personal, non-commercial purposes. This includes:

  • Reading, viewing, and applying the knowledge from our guides and tutorials
  • Using our resources for personal skill development
  • Sharing links to our content on social media with proper attribution
  • Discussing our content in forums, Discord, or other community spaces

6.2 Restrictions on Creator Content

6.4 Music Content

11. Merchandise and Purchases

Jade Vanity Gaming may offer merchandise, premium content, or other products for purchase. By making a purchase, you agree to the following terms:

11.1 Payment and Billing

When you make a purchase, you agree to provide accurate and complete payment information. You authorize us to charge your chosen payment method for the full amount of your purchase plus any applicable taxes and fees.

11.2 Refunds and Returns

Our refund and return policy for physical merchandise is as follows:

  • You may request a refund within 30 days of receiving your merchandise if it is defective or damaged upon arrival
  • To request a refund, contact us at support@jadevanitygaming.com with your order details
  • Digital products, including premium guides or content, are generally non-refundable unless otherwise stated at the time of purchase

11.3 Shipping

For physical merchandise:

  • Shipping times and costs will be provided at checkout
  • We are not responsible for delays due to customs, weather, or other factors outside our control
  • You are responsible for providing accurate shipping information

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. JADE VANITY GAMING EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

JADE VANITY GAMING MAKES NO WARRANTY THAT (I) THE SERVICE WILL MEET YOUR REQUIREMENTS, (II) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, OR (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS.

WHILE WE STRIVE TO PROVIDE ACCURATE AND HELPFUL INFORMATION IN OUR GUIDES, TUTORIALS, AND OTHER CONTENT, WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION PROVIDED. THE USE OF ANY INFORMATION OR MATERIALS ON THIS SERVICE IS ENTIRELY AT YOUR OWN RISK.

14. Limitation of Liability

IN NO EVENT SHALL JADE VANITY GAMING, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH THE SERVICE BY ANY THIRD PARTY, AND/OR (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT JADE VANITY GAMING IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

15. Indemnification

You agree to defend, indemnify, and hold harmless Jade Vanity Gaming and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of (i) your use and access of the Service, (ii) your violation of any term of these Terms, (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right, or (iv) any claim that your User Content caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Service.

16. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Jade Vanity Gaming operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

17. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the jurisdiction where Jade Vanity Gaming operates. Any judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

Notwithstanding the foregoing, we may seek injunctive or other equitable relief to protect our intellectual property rights in any court of competent jurisdiction.

18. General Provisions

Entire Agreement: These Terms constitute the entire agreement between you and Jade Vanity Gaming regarding the Service and supersede all prior and contemporaneous written or oral agreements between you and Jade Vanity Gaming.

Severability: If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

Waiver: Our failure to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.

Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may freely assign or transfer these Terms without restriction.
